Obligation to Have an Address for e-Delivery (e-Doręczenia)
New regulations have come into effect as of January 1st, 2025, requiring certain entities to have an address for electronic delivery (e-Doręczenia). Information about e-Doręczenia refers to the electronic equivalent of a registered letter with acknowledgment of receipt.
This service allows public entities, citizens, and businesses to use convenient and secure electronic deliveries, which are legally equivalent to traditional registered mail with acknowledgment of receipt. .
1. Obligation for New Entities
- Entities registering a business from January 1st, 2025, are required to provide an address for e-Delivery when submitting their application for registration in the business register.
2. Obligation for Entities Registered Before January 1st, 2025
- Entities entered in the business register before January 1st, 2025, will be required to have an address for electronic delivery starting from April 1st, 2025.
3. How to Create an e-Delivery Address?
- New Entities: The address is created automatically based on the data provided in the registration application.
- Existing Entities: A request to create an e-Delivery address must be submitted via the online platform managed by the Minister responsible for digitalization.
Who Does This Obligation Primarily Apply To?
The obligation to have an e-Delivery address applies primarily to:
- Commercial law companies (e.g., limited liability companies, joint-stock companies),
- Foundations and associations,
- Entities conducting business in other legal forms.
